利用規約 ~Terms of Use~

1.はじめに~First of All~

Katonbo's Appは、iOS用アプリケーション（以下「当アプリ」）を開発・運用し、ユーザへその機能を提供します。Katonbo's Appのサービスを利用するユーザについて、当アプリ利用の一切は本規約に従うことを同意の下での行為であるものとします。

Katonbo's App develops and operates iOS applications (hereinafter referred to as "this application") and provides the functions to users. For users who use the services of Katonbo's App, all use of this app shall be an act with the consent to comply with this agreement.

2.定義~Definition~

本規約において使用する用語の意義は、以下に定めるとおりとします。

・「Katonbo's App」とは当サイトの運営および当サイト上で紹介されているアプリの制作者、または制作者が提供するアプリら全般の総称を指します。
・「アプリ」、「当アプリ」とは、Katonbo's Appが提供するアプリを指します。
・「ユーザ」とは、Katonbo's Appが提供するアプリを利用する者を指します。

The meanings of the terms used in this agreement shall be as set forth below.
・ "Katonbo's App" is a general term for the operation of this site, the creators of the apps introduced on this site, or the apps provided by the creators. ・ "Apps" and "this app" refer to apps provided by Katonbo's App. ・ "User" means a person who uses the application provided by Katonbo's App.

3. 規約の変更~Change to The Terms~

・本規約は、Katonbo's Appの意向により、いつでも変更することができるものとします。変更の内容やその時期はKatonbo's Appが適切と判断する基準の下に周知、施行します。 

・変更後の規約は、Katonbo's Appが別途定める場合を除き、当ページ上に表示された時点から効力を生じるものとします。 

・本規約の変更の効力が生じた後にユーザーが該当するKatonbo's Appを利用した場合、ユーザは変更後の本規約すべてについて、同意したものとみなします。

・ This agreement may be changed at any time by the intention of Katonbo's App. The details and timing of the changes will be announced and enforced under the criteria that Katonbo's App deems appropriate. ・ Unless otherwise specified by Katonbo's App, the changed terms will be effective from the time they are displayed on this page. -If the user uses the applicable Katonbo's App after the change of this agreement takes effect, the user will be deemed to have agreed to all of the changed agreement.

4.個人情報の取扱い~Handing of Personal Infomation~

Katonbo's Appが、アプリ上で収集するユーザの個人情報の内容およびその使用に関して、「プライバシーポリシー」記載の内容に基づき、適切に取り扱うものとします。

Katonbo's App shall handle the content of the user's personal information collected on the app and its use appropriately based on the content described in the "Privacy Policy".

5.課金機能について~About Billing Function~

Katonbo's Appは基本機能に加えて、より高度な機能を有料サービスとして提供する場合があります。
有料サービスにかかる料金体系や決済方法の策定、トラブル時の対応(返金、賠償等)について、その内容をKatonbo's App独自の基準、またはKatonbo's Appとユーザ間のみでの協議、判断によって決定されることは一切ありません。
上記はすべてKatonbo's Appのリリース先であるApple App Storeが定める規格および規約に則って行うものとします。

Katonbo's App may offer more advanced functions as a paid service in addition to the basic functions. The content of the fee structure and payment method for paid services, and the response to troubles (refunds, compensation, etc.) shall be determined by Katonbo's App's own standards, or by discussion and judgment only between Katonbo's App and the user. 6. 利用環境~Useage Environment~

・Katonbo'sAppを利用するために必要なあらゆるハード・ソフトウェア等および通信手段の整備は、ユーザの負担と責任において行うものとします。 

ユーザは自己の利用環境に応じて、コンピュータ・ウィルスの感染の防止、不正アクセスおよび情報漏洩の防止等の対策を講じるものとします。 

・Katonbo'sAppはユーザの利用環境について関与せず、また責任を負いません。ユーザが利用した機器・回線・ソフトウェア等により生じた責任および損害、ならびに、ユーザが本サービスを利用する上での過誤による責任および損害は、ユーザが負うものとし、Katonbo'sAppはユーザの故意や過失の有無を問わず、責任を負いません。 

・Katonbo's Appが提供するサービスは、ユーザの特定の目的に適合すること、期待する機能・商品的価値・正確性・有用性を有すること、および不具合が生じないことについて、何ら保証するものではありません。
・アプリの仕様、サービス内容については、制作者の意図に応じて随時変更される可能性があります。アプリ提供の終了や仕様変更、または利用不能やKatonbo's App利用によるデータの消失または端末の故障、損傷、その他ユーザーが被った損害については、賠償する責任を一切負わないものとします。

-The maintenance of all hardware, software, etc. and communication means necessary for using Katonbo's App shall be done at the user's expense and responsibility. The user shall take measures such as prevention of computer virus infection, unauthorized access and information leakage according to his / her usage environment. -Katonbo's App is not involved in or responsible for the user's usage environment. The user shall bear the responsibility and damage caused by the equipment, line, software, etc. used by the user, and the responsibility and damage caused by the user's mistake in using this service, and Katonbo's App shall be the user's intention or damage. We are not responsible for any mistakes. ・ The services provided by Katonbo's App do not guarantee that they will meet the specific purpose of the user, that they will have the expected functions, commercial value, accuracy, and usefulness, and that they will not cause any problems. .. -The specifications of the application and the contents of the service may be changed at any time according to the intention of the creator. We shall not be liable for any damages incurred by the user, such as the termination of the application, specification changes, unavailability, data loss due to the use of Katombo's App, device failure, damage, or any other damages suffered by the user.

7.ユーザの責任~User responsibility~

・ユーザは、自己の責任においてKatonbo's Appを利用するものとし、Katonbo's Appを利用してなされた一切の行為およびその結果についての責任を負います。 

・ユーザが本規約に違反したことにより、Katonbo's Appまたは第三者に損害が生じた場合、ユーザはその損害を賠償する責任を負います。 

・ユーザと第三者との間で、Katonbo's Appに関連して生じた紛争に関して、当該ユーザは自身の責任と費用で解決するものとし、Katonbo's Appは、当該紛争に関与しません。また、当該ユーザは、当該紛争に関連してKatonbo's Appに生じた損害（弁護士費用その他のKatonbo's Appが当該紛争に関連する対応のために支払った費用及び賠償金等を含むが、これらに限りません。）を賠償するものとします。但し、当該紛争の発生がKatonbo's Appの故意又は重過失による場合はこの限りではありません。

-The user shall use Katonbo's App at his / her own risk, and shall be responsible for all actions taken using Katonbo's App and the results thereof. ・ If the user violates this agreement and causes damage to Katonbo's App or a third party, the user will be liable for the damage. -The user shall resolve any dispute arising between the user and a third party in connection with the Katonbo's App at his / her own risk and expense, and the Katonbo's App shall not be involved in the dispute. In addition, the user includes, but is not limited to, damages (attorney's fees and other costs and compensation paid by Katonbo's App for the response related to the dispute) caused to Katonbo's App in connection with the dispute. H.) shall be compensated. However, this does not apply if the dispute is caused by Katonbo's App intentionally or by gross negligence.

8. 著作権・知的財産権等~Copyright,Intellectual property rights,etc~

・Katonbo's Appに関する著作権その他一切の権利は、アプリの制作者又は権利を有する第三者に帰属します。

・ The copyright and all other rights related to Katonbo's App belong to the creator of the app or the third party who owns the rights.

9.本規約の有効性~Validity of this Agreement~

・本規約の一部が法令に基づいて無効と判断されても、本規約のその他の規定は有効とします。 

・本規約があるユーザとの関係で無効とされ、または取り消された場合でも、本規約はその他のユーザとの関係では有効とします。

・ Even if a part of this agreement is judged to be invalid based on the law, the other provisions of this agreement will be valid. -Even if this agreement is invalidated or canceled in relation to a certain user, this agreement is valid in relation to other users.

10.準拠法~Governing Law~

・本規約及び個別規約等の準拠法は、日本法とします。 

・ The governing law of this agreement and individual agreement shall be Japanese law.
